As Halloween approaches, it’s a perfect time to face some “spooky” questions about your estate planning. While they might seem “scary”, these questions are essential for ensuring your loved ones are taken care of when you’re no longer here. By confronting these “spooky” topics now, you can make the process easier for both yourself and your family.

First, consider: What will happen to my assets? This is a crucial question that requires deep thought about how you want your belongings distributed. Without a clear plan, your assets may end up in a lengthy probate process, leading to potential disputes among family members. 

Next, ask yourself: Who will care for my children? If you have minor children, deciding on a guardian is perhaps the most critical choice you’ll make in your estate plan. It’s essential to choose someone you trust to raise your children according to your values. If you don’t legally nominate guardians for your children, a judge will pick them for you, and they could end up picking the last person you’d ever want!

Another important question is: What are my final wishes? Do you prefer burial or cremation? Do you have any special wishes? One client of mine wanted her ashes thrown from a hot air balloon! Communicating these wishes to your loved ones can relieve them of the burden of making difficult decisions during an emotional time.

Finally, consider: How can I minimize taxes and fees? If your estate is big enough, a big chunk of it may go to state or federal estate taxes. The good news is that with proper planning, you can reduce or eliminate these taxes entirely.
